Terms of Service for Covenant Brands

Welcome to Covenant Brands! We are dedicated to spreading God's Word through our unique clothing, jewellery, and apparel. These Terms of Service ("Terms") govern your use of the www.covenantbrands.co.za website ("Site") and any products or services offered by Covenant Brands.

By accessing or using our Site, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Site or use our services.

1. Acceptance of Terms

By creating an account, making a purchase, or otherwise using the Site, you confirm that you are at least 18 years of age (or the legal age of majority in your jurisdiction) or are accessing the Site under the supervision of a parent or guardian, and that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Returns Policy.

Covenant Brands reserves the right to modify or replace these Terms at any time. We will indicate the "Last Updated" date at the top of this page. Your continued use of the Site after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically.

3. Products and Services

a. Product Descriptions: We strive to ensure that all product descriptions, images, and prices displayed on the Site are accurate. However, we do not warrant that product descriptions or other content of this Site is accurate, complete, reliable, current, or error-free. If a product offered by Covenant Brands is not as described, your sole remedy is to return it in unused condition, as per our Returns Policy.

b. Pricing: All prices are listed in South African Rand (ZAR) and exclude delivery costs unless otherwise stated. Prices are subject to change without notice. In the event of a pricing error, we reserve the right to cancel any orders placed for the product at the incorrect price.

c. Availability: All products are subject to availability. Many items are "Made to Order," and delivery times will be specified (e.g., 10-14 days). We reserve the right to discontinue any product at any time.

d. Made-to-Order Items: Products specified as "Made to Order" will commence production only after your order has been successfully placed and payment confirmed. Due to the custom nature, these items typically have a specified production and delivery timeframe.

4. Orders and Payment

a. Order Confirmation: After placing an order, you will receive an email confirmation acknowledging receipt of your order. This email does not signify our acceptance of your order, but merely confirms that we have received it.

b. Acceptance: All orders are subject to acceptance by us. We reserve the right to refuse or cancel an order for any reason, including but not limited to product availability, errors in the description or price of the product, or error in your order.

c. Payment: All payments must be made in South African Rand (ZAR) through the payment methods provided on our Site (e.g., PayFast, Peach Payments). By submitting an order, you represent and warrant that you are authorized to use the designated payment method and authorise us to charge your order to that payment method.

5. Shipping and Delivery

a. Delivery Times: Estimated delivery times (e.g., 10-14 days) are provided for each product. These are estimates only and are not guaranteed. Delays may occur due to unforeseen circumstances, courier issues, or high demand. b. Shipping Costs: Delivery costs will be calculated at checkout based on your location and order size. c. Risk of Loss: All products purchased from the Site are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

7. User Accounts

a. Account Creation: If you create an account on our Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. b. Accuracy of Information: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

8. Intellectual Property

All content on this Site, including but not limited to text, graphics, logos, images, product designs, and software, is the property of Covenant Brands or its content suppliers and is protected by South African and international copyright, trademark, and other intellectual property laws. The "I am the Way" and "He Is Risen" designs are proprietary to Covenant Brands. You may not use any content from the Site without our express written permission.

9. User Conduct

You agree not to use the Site for any unlawful purpose or in any way that might harm Covenant Brands or any third party. Prohibited conduct includes, but is not limited to:

• Violating any applicable laws or regulations.
• Impersonating any person or entity.
• Transmitting any material that is defamatory, offensive, or otherwise objectionable.
• Attempting to gain unauthorised access to our Site or computer systems.

10. Disclaimers

The Site and all products and services offered are provided on an "as is" and "as available" basis. Covenant Brands makes no representations or warranties of any kind, express or implied, as to the operation of the Site or the information, content, materials, or products included on the Site. To the full extent permissible by applicable law, Covenant Brands disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

Covenant Brands SA will not be liable for any damages of any kind arising from the use of this Site or from any products purchased from the Site, including, but not limited to direct, indirect, incidental, punitive, and consequential damages.

You agree to indemnify, defend, and hold harmless Covenant Brands, its owners, employees, and affiliates from and against any and all claims, damages, costs, and expenses, including attorneys' fees, arising from or related to your use of the Site or any breach by you of these Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of South Africa. Any disputes arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the courts of South Africa.
